Hearing of Kulbhushan Jadhav's case today by ICJ

The International Court of Justice (ICJ) located in The Hague will pronounce its verdict Wednesday on Kulbhushan Jadhav, an Indian Navy official imprisoned in Pakistan on Wednesday. In this case, India is hoping for a decision on its behalf. A military court in Pakistan has sentenced Jadhav to hang till death on charges of espionage, against whom India has gone to the international court. While hearing the case, the ICJ stopped Jadhav's death sentence in May 2017 and secured his decision.



Pakistan says it accused Jadhav of Baluchistan on March 3, 1996, for alleged espionage, while India has rejected its claim. India says that the naval officer Jadhav was kidnapped from Iran and brought to Pakistan. Jadhav has his business in Iran. Explain that India has filed a case in ICJ by making this case based on a violation of the Vienna Treaty and Legal Process. Jadhav was sentenced to death in April 2017 for a military court in Pakistan accused of spying and spreading terrorism in the country. At the same time, the ICJ asked Pakistan to suspend the orders till its decision.

India has demanded the cancellation of the death sentence awarded to Jadhav by the ICJ and his immediate release. India says that the military court of Pakistan did not follow the standard procedures necessary to blame Jadhav. In December 2017, Jadhav's mother and wife visited Pakistan but Pakistan mistreated her mother and wife. Even he did not allow his wife to wear Mangalsutra and bangles during meeting. When Jadhav was meeting his mother and wife, during that time there was a glass wall between them. India said that 'this whole process of the meeting was intimidating.' After this meeting, the Ministry of External Affairs said that Jadhav's mother and wife were forced to wear second clothes before the meeting and they were not allowed to speak in the mother tongue.

Let us know that the decision of ICJ is going to come in a time when a meeting between India and Pakistan was held on the Wagah border on Sunday to finalize the procedures of the Kartarpur Corridor. After the crucial decision of ICJ, Pakistani Prime Minister Imran Khan will leave for America next week. There is a possibility that the ICJ can ask Jadhav to repeat the case and Pakistan to "fair and transparent" hearings.

Significantly, Pakistan had sentenced Sarabjit Singh to death in the case of espionage, but Sarabjit was killed in the prisoner's attack. Sarabjit remained in Pakistan's jail for 22 years. While second citizen of India, Hamid Ansari, released from Pakistan last year. Senior advocate Harish Salve, while keeping Indian side in ICG, said that apart from "Jadhav's confession", Pakistan has no other evidence.

He said, "Pakistan claims to have irrefutable proof based on articles published in the Indian media." Salve said about Jadhav's citizenship, "Jadhav is a former officer of the Indian Navy, which is proof of his nationality." The senior lawyer said, "Like Pakistan, India has never needed to deny the nationality of its citizens. Indians are not such that their nationality needs to be rejected. ‘Salve said that Pakistan tried to give the wrong direction to the ICJ thrice in the ICJ but all its efforts failed.
